These Terms and Conditions apply to all trips and travel services arranged for or provided to you (“client”, “participant”, “you,” or “your” which terms shall be deemed to refer to you and all the persons named on the booking), by Casa, Ltd. (“we”, “us” or “our”). Please read them carefully, as they set out your contract with us once you have paid your deposit (or any subsequent payment).
1.1. To book a trip with us you must first contact us to discuss your itinerary and request a quotation.
1.2.After our initial conversation, if you would like our team to proceed with planning your trip and creating a customized itinerary, we will require receipt of an itinerary development fee of 400 EUR. Because of the time and attention we put into handcrafting each journey, this fee serves as an agreement that you are dedicated to working us. This fee will be credited toward your final balance, but is not refundable should you decide to cancel.
1.3.After we have received your itinerary development fee, we will propose a specific itinerary with the dates or date range based on your availability. We will be ready to discuss itinerary details and will continue to make adjustments based on your feedback. Once you have approved the proposed itinerary, we will reserve space at the chosen hotels and provide you with an exact trip cost.
1.4.Once the itinerary has been agreed and in order to secure a booking, we require a deposit of 50% of the total trip price or, in the case of bookings made within 15 days of the trip start date, the full holiday price will be payable. In some cases, the deposit may be higher if there are larger non-refundable supplier amounts due, but we will let you know at the time of booking if this is necessary. Please note that until we have received your deposit payment, all arrangements are subject to availability and/or price change.
1.5.Once we receive the deposit we will issue a written confirmation of the booking, at which point a binding contract is formed between us.
2.Changes by you
2.1. If, after we have confirmed a booking, you request a change in the dates or elements of your itinerary we will do our best to meet your revised requirements. If the requested amendments are possible, you will be provided with a quote including any additional costs imposed by our suppliers if applicable.
2.2.Any such requests received within 15 days before the trip start date will be treated as a cancellation and re-booking and thus subject to cancellation charges.
3.1. Final payment (50% of the total trip price) is due 15 days prior to the trip start date or as agreed. If the balance payment is not received by the due date, Casa reserves the right to release your booking and assumes that the trip has been cancelled by you. In this case, our standard cancellation fees would apply.
3.2.All payments to Casa are to be made by wire transfer directly into the bank account of Casa or as agreed. The bank details will be mentioned in the invoice.
3.3. If decided to pay by card, clients should pay all bank charges for bank transfers. Failure to do so may lead to you being re-billed.
4.1.All prices are quoted in EURO, unless otherwise noted.
4.2.The price of the trip is based on costs known at the date of booking and on relevant rates as at that date, it is subject to variation only to reflect subsequent increases in transportation costs (including fuel and air fares), dues, taxes (including VAT) and fees chargeable for services or adverse exchange rate variations.
4.3.Even in the above cases, Casa will not increase the price if the fluctuations are less than 2%, but if the necessary price increases exceed that level then we will notify you accordingly and reserve the right to charge you that extra amount up to a maximum of 10%. If the increase is in excess of 10% of the total cost, you will have the right to cancel the trip and we will give you a full refund of all money paid to the company less an administrative charge of 200 EUR per person. However, you must advise Casa in writing within 5 days of receiving the increased invoice in order to cancel your trip.
5.Cancellation by you
5.1.Cancellation instructions by you must be in writing (email or post) to us and will be effective on the day we receive them.
5.2.As we incur costs from the time of your booking, the following cancellation charges will be applied. Cancellation charges apply as a percentage of the total trip price, as follows:
- Cancel more than 90 days prior to trip start date – full refund (minus 300 Euros retained for itinerary development fee)
- Cancel between 90 – 15 days prior to trip start date – 50% cancellation charges will be applied (deposit only)
- Cancel less than 14 days to trip start date – 100% cancellation charges will be applied
**For groups larger than 6 participants, special booking and cancellation policies apply. Please contact us for further information.
5.3.Where we have informed you that a booking is non-cancellable, no refund will be made for cancellation. Nevertheless, we will do our best to obtain a measure of refund for you from the supplier if possible.
5.4.In the event that the cancellation charges of the suppliers we use are more than ours, then the suppliers’ cancellation terms will apply.
5.5.If a participant cancels in a double occupancy room, the remaining participant must pay the single supplement unless otherwise specified.
5.6.No allowance or refund is provided for unused meals, accommodation, transport, or other pre-paid services, when these are included in the trip price nor once the trip has started can we give any refunds for cancelling part of the trip.
5.7.If your reason for cancelling is because of events beyond your control ( illness, death of a family member etc.) you may transfer your booking to another party provided that you give us reasonable notice to make such arrangements and that you and the transferee agree to be jointly liable for any outstanding payment under the contract. Any transfer fee incurred will fall under the responsibility of the client.
5.8.Some tours are based on minimum numbers of passengers travelling; if the number of passengers falls below the minimum required, a surcharge may be imposed or the tour cancelled.
Failure to travel without prior notification is considered a no-show and the entire cost of reservation is non-refundable.
7.Changes and cancellations by us
7.1. Most changes are minor and we will inform you of them as soon as possible. Occasionally, a major change needs to be made. Major changes may include: change of your destination, price increase, or change of your accommodation to a lower grade. If we make a major change to your holiday we will inform you in due time. You will then have the choice of: (a) accepting the changes, (b) accepting an offer of an alternative trip from us of a similar standard to that already booked, or (c) cancelling your trip and receiving a full refund of all monies due.
7.2. Accommodations, transportation and arranged activities are subject to change at any time due to unforeseen circumstances or circumstances beyond our control including, without limitation, hotel issues, transportation cancellations, delays and other schedule changes. We are not responsible for such unanticipated and uncontrollable changes, and any expenses resulting from such changes (e.g. additional accommodation, transportation, or guide fees, etc.) will be paid by you. You may be eligible to recover such costs from your travel insurance supplier.
7.3.Casa retains the right to cancel your trip entirely in extreme circumstances, for example if your safety or the quality of the trip, in our sole opinion, is deemed to be compromised. If we cancel your trip, we will refund what you have paid us, but we cannot be held responsible for losses you may incur with third parties, such as airlines, hotels or others. Cancellation insurance is recommended.
7.4.We reserve the right to terminate the holiday arrangements of any person whose behavior is such that it is likely, in our reasonable opinion or tour leader, hotel manager, or other person in authority, to cause distress, danger, damage, or annoyance to other participants, staff, and property or to any third party. Should this happen, full cancellation charges will apply, and we will have no responsibility whatsoever for any costs incurred for the continuation of the holiday, including any return travel, or to compensate for any loss incurred.
7.5.We will not accept liability if a ‘force majeure’ imposes us to change or cancel your trip
Casa will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay, change in performance or non performance of any of its obligations under this agreement if such delay, change or non performance is due to any Force Majeure. “Force Majeure” means any circumstances beyond our control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, terrorist activity (actual or threatened), industrial dispute, technical problems with transports, machinery or equipment, power failure,, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.
The trip price does not include travel insurance. We recommend you to purchase comprehensive travel insurance and make sure that all of the activities which you will be carrying out are covered under such insurance, protecting against unforeseen circumstances that could interfere with your travels. Cover must include medical expenses and repatriation in the event of accident or illness. In addition, we strongly recommend that you have cover for personal belongings,overseas legal expenses and cancellation, flight or other transportation delays, personal liability. If you are undertaking any sports or adventurous activities on your trip you should also make sure that your policy covers these. Please read carefully the policy conditions and exclusions.
10.1.It is your responsibility to be ready to leave from the departure city at the specified day and time. We are not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.
10.2.Your additional responsibilities include, but are not limited to, strictly complying with all local laws, respecting customs and culture, adequately assessing your abilities, respecting other participants’ privacy, and if on a guided trip following the suggestions and advice of the guide/ tour leader.
10.3.It is your responsibility to obtain valid and effective documentation, including passports, visas, permits, and vaccinations, if necessary. You also assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements.You are solely responsible for any adverse consequences resulting from missing or defective documentation. All travellers, regardless of the holder’s passport, must check with the consulates of Romania to determine if a visa is required for their nationality. A copy of your valid passport must be submitted to Casa. Your passport must have at least six (6) months remaining on the passport from the date of return otherwise your passport must be renewed. Also, make sure there are sufficient pages left in your passport, at least two (2) pages, for validity of the passport.
10.4.Casa may provide information or advice given on visas, climate, clothing, baggage, special equipment, etc. in good faith as a courtesy to you. We are not responsible for any errors or omissions as to the information provided.
11.1.We accept responsibility for ensuring that the trip arrangements that you book with us are supplied as described in the itinerary provided, and in compliance with these terms and conditions. We will respond to your messages shortly and will keep you informed as your itinerary evolves. If at any time you have questions or concerns we ask that you let us know immediately so we can address them.
11.2.We endeavor to keep the website and any other media support up to date, but cannot guarantee their accuracy and, if there is any inconsistency between the information on our website and the itinerary details provided to you, the itinerary details prevail.
12.Limitation of Liability
12.1.Casa is acting at all times as a reservation agent for all suppliers who provide the services listed in the itinerary details. The suppliers providing transportation, accommodations, and/or other services, (“Suppliers”) for the trip are independent contractors and are not agents, affiliates, representatives or employees of Casa. Casa, has no ownership interest in any Supplier. These suppliers are responsible for their performance. Any use of the Casa name by a Supplier is for identification purposes only and does not constitute ownership, supervision or control by Casa . All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier. By utilizing the services of the Suppliers, you agree that Casa shall not be liable forany accident, loss, injury or damage to you or to those travelling with you in connection with any transportation, accommodations or other services or resulting directly or indirectly from any occurrences or conditions including, but not limited to, negligence, vehicles or equipment malfunction, strikes, “Acts of God,” riots, acts of governmental authority, terrorist acts or threats, wars, theft, delays, weather conditions, environmental conditions, bankruptcy, cancellations or changes in itineraries or schedules orloss or damage to property or injury to persons, caused by reason of any act or omission, intentional, negligent or otherwise by such third party Suppliers.
12.2 While we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability with respect to the information on this website and Casa does not accept any liability for error or omission.
You consent that Casa may use, re-use, and reproduce in its own name any photos or videos that you send to us, or that other travellers took of you individually or in a group, on any media support, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promotion and publicity purposes worldwide related to our travel products and services. If you do not want us to use any images of you that are taken by us or other participants during the trip, you must inform us before your trip starts.
14.Claims and Complaints
If you experienced am issue or something that does not meet your expectation, you must promptly notify us or our local operator, guide or supplier so that the problem can be rectified, if possible. If you make any changes on your own without following the notice procedure described above, you assume responsibility for any added costs you may incur and forfeit any potential refunds. If satisfaction is not reached through this notice procedure during the trip, you must submit further complaint in writing to us within 5 days of the end of the tour. We will not accept any liability for claims received after this period.
15.Assumption of risk
15.1.You understand that the trip may include on your request and with your approval activities or circumstances that involve a possible risk. You agree to take full responsibility for your safety and welfare, including, without limitation, unanticipated events such as injury, illness, theft, emotional trauma, death, forces of nature, cancellation, weather, civil unrest, acts of civil or military authority, fire, flood, insurrection, quarantine, war, terrorism, force majeure, delays, epidemics, strikes or labor disputes, mechanical failure, accidents, government regulation, lack of essential supplies or parts, any occurrences beyond our direct control, itinerary changes or modifications, and for all transportation including land vehicles, boats and aircraft that are not necessarily operated or maintained to standards found in your country.
15.2.You assume all risks associated with altitude, illness, disease, physical injuries, sustained, alcohol consumption, physical exertion and sporting activities, knowing that access to evacuation and/or suitable medical supplies and support may not be available.
15.3. You take full responsibility for any injury, loss or damage suffered by you or caused by you and are responsible for personal baggage and personal possessions and effects.
All materials posted on this website are property of Casa. Any use, reproduction, modification, republication or distribution of all or part of any material found on this website is expressly prohibited unless Casa has explicitly granted its prior written consent to do so. All other rights reserved.
These terms and conditions and any disputes arising from them shall be governed by Romanian law shall be within the exclusive jurisdiction of the courts of Romania. The sale of this travel package will comply with these terms conditions and the provisions of Government Ordinance no. 107/1999 on Package Holidays and Package Tours Regulations, amended and approved by Law no. 631/2001, Order no. 516/2005 of 12/04/2005 published in the Official Gazette, Part I no. 334 of 20/04/2005 with subsequent amendments.
19.Changes to Terms and Conditions
The terms and conditions which apply to your trip are those which are featured on your booking form at the time of booking, and any other terms notified to you in writing before departure. We reserve the right to update these terms and conditions from time to time. Any such updates shall take effect immediately upon posting on our website.
